The following terms apply to those who register for a Nonprofit Mastermind Group Membership or Retreat.
Parties to Agreement
Services included in this package are between High Five Career Coaching (aka “High Five”) and enrolled Mastermind Group Member (aka “Member”)
Duration of Agreement
This Agreement will be in effect for an initial period of 12 months for the Monthly Nonprofit Executive Mastermind package and/or 12 months for the Nonprofit Executive Mastermind Retreat Series unless if Member selects the “single Retreat” option).
Brief Mastermind Group Description
The Nonprofit Executive Mastermind Group is a confidential peer group convened for the purpose of providing members mutual support and problem-solving of meaningful business challenges. A trained facilitator and coach will guide members through a structured process to enable them to tackle challenges and benefit from the coaching, ideas, perspectives, advice, and wisdom of their peers.
Services Provided to Group Members
High Five will provide services to Members as they are described on the High Five Career Academy website for Nonprofit Executive Mastermind Retreat, Monthly Nonprofit Executive Mastermind, Mastermind Bundle, and/or Private Executive Coaching Bundle.
Expectations of Group Members
- Maintains confidentiality of Mastermind group discussions (i.e. what’s said in the group stays in the group)
- Pays for enrolled packages in advance unless choosing available payment plan options. Ensures payments are made by the first of each month including automatic monthly payments for entirety of enrollment period
- Aware of all meeting dates, times, and locations as outlined on Mastermind group pages and understands all meetings will either be in person for the Nonprofit Executive Mastermind Retreats or virtually via Zoom for the Monthly Nonprofit Executive Masterminds.
- If unable to attend a Mastermind session, Member will notify High Five as far in advance as possible (by email or text) and understands there are no “make up” sessions or recordings, notes that will be shared
- Understands that if two or more sessions are missed in a six month period, membership may be suspended or canceled by High Five and/or at the behest of group Members
- Treats High Five staff, expert advisors, guest speakers, and fellow group members with respect and professionalism at all times
- Will not market or solicit business from other group members during Mastermind group meetings
- Confirms that High Five bears no responsibility or liability for Members’ acceptance, rejection, execution, or failure to execute any advice, recommendations, ideas received as an outcome of group discussions, presentations, or consults. If there are any doubts, Members should seek counsel from their own private legal, financial, human resources, or therapeutic professionals.
- Understands 1:1 and group sessions are not to be construed as psychological counseling or therapy.
Confidentiality
Members are responsible for what they choose to disclose to other group members and are expected to keep the content of group discussions confidential other than what group members have consented to being shared outside of group sessions. Meanwhile, High Five’s Facilitator/Coach will maintain the strictest levels of confidentiality with all Member information and will not disclose the information to third parties without a clear agreement upon how coaching information will be exchanged.
Conflicts of Interest
High Five will seek to avoid conflicts of interest and potential conflicts of interest. Facilitator/Coach will openly disclose any such conflicts and will offer to remove him/herself when such a conflict arises. High Five will not use information shared by Members for its own benefit or any third party.
Limitations: The Facilitator/Coach and Expert Advisory Team members are required to report information to the appropriate parties pertaining to a Member who is at risk of harming him/herself and/or others or if otherwise required by law. As part of the Coach’s certification process s/he may need to report some limited information to the International Coach Federation for purposes of verifying coaching hours and nature of coaching provided. Information needed for this purpose will be explained to the client and must be agreed upon by the client in writing in advance.
Cancellation/Refund Policy
If not fully satisfied with the Mastermind group after the first session and before the next session, High Five will do everything we can to satisfactorily address the Member’s concerns. If Member is still not satisfied and wishes to discontinue membership, s/he must notify High Five Career Coaching in writing and membership fees paid to High Five will be refunded on a pro-rated basis to Member. A Member’s failure to attend scheduled sessions will be forfeited and no refunds will be provided for any missed sessions.
Alternate Dispute Resolution
In the event of a dispute, both parties shall first attempt to resolve any issues directly in good faith. Both parties agree to settle any unresolved dispute connected to this Agreement via mediation in San Diego in accordance with and subject to the laws of the State of California. In the event any part of this agreement is found to be void or legally unenforceable, the remaining provisions shall remain in effect in accordance with the spirit and intent of both parties.
Media Release
Member gives permission to High Five to record video, audio, and photographs of the Mastermind sessions and obtain written/verbal testimonials for instructional and/or marketing purposes (however, confidential conversations will not be recorded unless specific consent is requested by High Five and received by all Members for that particular session) You agree to grant all rights to reproduce these recordings in any format now known or from this point forward devised including media such as photos, video and/or audios, etc. for newsletters, brochures, marketing materials, new products, etc. with no compensation or credit to you or your organization. As such, you hereby irrevocably agree that you will not assert a claim, maintain an action or suit and will not consent to the assertion or maintenance by others of any claim, action or suit of any kind against High Five Career Coaching or any associates/partners or relating to any of the rights herein granted.
Changes/Amendments to the Agreement
This agreement supersedes any prior agreements. Any changes must be agreed upon in writing by both High Five and Member and will be applied to this Agreement.
By checking the box agreeing to Terms of Service during the registration process, Member acknowledges to have read and agrees to abide by the above stated Terms of Service.
